When is a break room mandatory?

Under the German Workplace Ordinance (ArbStättV) and the implementing rule ASR A4.2, a break room or break area must be provided where more than ten employees work, or wherever safety and health demand it, for example during demanding tasks. The room offers undisturbed recovery away from the workstation.

Regardless of headcount, a dedicated break room is always required when burdens such as noise, dirt, wetness or hazardous substances would persist during the break. Staff with mainly seated or standing work must be able to sit down and set aside their work clothing.

A break area is sufficient in businesses with no more than ten employees. It must be physically separated from the workstation and must not sit in a traffic route or the immediate production zone.

How much area and how many seats?

ASR A4.2 specifies a floor area of at least 1 m² per simultaneously present employee, including tables and seating. The total area of the break room should not fall below 6 m². Clear headroom follows ASR A1.2 and is at least 2.50 m depending on room size.

The maximum number of people present during the busiest break is decisive, not the total workforce. Each person needs a seat with a backrest and table space. This makes the area requirement straightforward to plan.

Allow movement space between tables of at least 0.80 m so occupied chairs do not block passage.

What equipment does the break room need?

Basic equipment includes tables, seating with backrests and a way to heat and store food and drinks. A kitchenette with a sink, fridge and microwave meets this requirement in practice. Drinking water or a beverage supply should be within reach.

  • Kitchenette with sink, hot and cold water and adequate worktop.
  • Refrigerator for storing food brought from home.
  • Microwave or heating option for warming meals.
  • Tables and chairs with backrests for every simultaneous user.
  • Coat hooks or a wardrobe for work clothing, kept away from food.
  • Adequate lighting and a clock to keep track of break time.

The break room must be heatable and allow a room temperature of at least 21 °C. A visual connection to the outside and sufficient ventilation raise the recovery value. Production noise should not reach the room, and a rating level below 55 dB(A) is the target.

In non-smoking workplaces, protection from tobacco smoke under ArbStättV is mandatory. A break room must not double as a passageway or storage space.
